Refund and Cancellation Policy

1. Nature of Payment

Payments made on brickrise.app represent an Expression of Interest (EOI) for token reservation with SKA Group. These payments are not purchases of a product or service and do not constitute a binding sale, share allotment, transfer of any asset, or any right to receive money back. By making a payment, you confirm that you have read and accepted the terms of this policy, the Terms and Conditions, and the Privacy Policy, and that you have had sufficient opportunity to review all project information before paying.

2. Cancellation Policy

Once an EOI payment is submitted, the reservation it secures is considered confirmed and cannot be cancelled by the applicant. Cancellation requests will not be entertained, except at the sole discretion of SKA Group. You are advised to verify all details, including the payment amount, the project details, and your eligibility, before completing a transaction. No cooling-off period applies.

3. Refund Policy

All EOI payments are non-refundable once submitted. No refund is due, payable, or guaranteed under any circumstance, and nothing in this policy, the platform, or any communication shall be construed as a promise or entitlement to a refund. Refunds, where granted, are discretionary and made only at the sole discretion of SKA Group, in accordance with applicable law.

4. No Guarantee of Allocation

An EOI payment reserves your interest only and does not guarantee that a token will be allocated to you. Token allocation is subject to eligibility, availability, verification, and the sole decision of SKA Group. Non-allocation, delayed allocation, or rejection of an application does not entitle you to any refund.

5. Refunds Are at SKA's Discretion

All refunds, whether full or partial, are granted solely at the discretion of SKA Group. No refund is guaranteed under any circumstance, including project changes, delays, abandonment, non-allocation, or any other reason. Any refund that is considered is handled entirely offline by SKA Group directly and is not processed through this platform.

6. How Refund Requests Are Handled

All refund and cancellation matters are handled offline by SKA Group. To raise a request, write to info@skaindia.co.in with your Application ID and the reason for the request. SKA Group will review and respond to you directly at its own pace and discretion. SKA Group is not responsible for any delays in responding to or processing requests received by email, and no request is deemed accepted unless confirmed by SKA Group in writing.

7. Offline (Bank Transfer) Payments

Payments made by bank transfer or cheque are verified manually. Any dispute or refund request relating to such payments is handled offline by SKA Group at its sole discretion. Please contact us directly for assistance. SKA Group is not liable for any loss arising from incorrect bank details provided by you or from the failure of any third-party bank.

8. No Liability

To the maximum extent permitted by law, SKA Group shall not be liable for any loss, damage, cost, claim, or expense (including any indirect, consequential, or special loss) arising out of or in connection with your EOI payment, the project, or this policy. This includes, without limitation, any project delays, changes to project plans, pricing, specifications, or timelines, or the abandonment of any project. SKA Group's total liability, if any, shall not exceed the amount of the relevant EOI payment, and only where a refund is granted at SKA Group's sole discretion.

9. Investor Responsibility

You are solely responsible for ensuring that you understand the project, your investment, and your obligations before making an EOI payment. You confirm that you have not relied on any oral or unauthorised representation, and that you have reviewed all project documentation made available to you. Mistakes made in the course of payment, such as entering the wrong amount or paying twice, are your responsibility and do not create any entitlement to a refund.

10. No Guarantee of Returns

Nothing on brickrise.app constitutes investment, legal, or financial advice. An EOI payment does not guarantee any return, appreciation, profit, or successful completion of the project. The value of any allocation is subject to market and project risks, and you acknowledge that you may not receive any return on your payment.

11. Force Majeure

SKA Group shall not be liable for any failure or delay in performing any obligation to the extent caused by circumstances beyond its reasonable control, including acts of God, government action, regulatory changes, pandemics, natural disasters, strikes, power or network failures, or failures of third-party payment processors or banks. Any such event does not create any right to a refund.

12. Amendments to This Policy

SKA Group may amend this policy at any time without prior notice. The latest version will be published on this page and will apply to all payments made after its publication. Your continued use of brickrise.app or any payment made after an amendment constitutes acceptance of the amended policy. You are encouraged to review this page periodically.

13. Governing Law and Jurisdiction

Any dispute regarding a refund or cancellation will be resolved in accordance with the Terms and Conditions and the laws of India. The courts at Noida, Uttar Pradesh shall have exclusive jurisdiction over any such dispute.
